Terms of Service

The agreement

These terms are a contract between you and Ranklog (“we”, “us”, “our”) for Mickey Banks on textmickey.com and over iMessage. Ranklog operates the service and is the contracting party. Ranklog is organized in [RANKLOG STATE OF INCORPORATION]. If you do not agree, do not use the site and do not text the line.

“You” means the person who uses the service. If you use it for a school, a program, or another organization, “you” includes that organization, and you represent that you have authority to bind it.

Mickey has no separate login. The phone that sends the message is how we tell texters apart. How we handle that number and your messages is in the Privacy Policy.

Who may use Mickey

You may use Mickey only if you are at least [MINIMUM AGE] years old and able to agree to these terms. We do not ask your age in the thread or on the form, so you have to judge this yourself. By using the service, you represent that you meet this requirement.

The service is not for children. Players named in the scouting notes are often high school age. That does not make a player a customer, and it does not mean you may use the thread to contact a minor.

The service

Mickey Banks is an artificial intelligence assistant for high school basketball scouting. You reach him by iMessage. On textmickey.com you enter your name and mobile number, and we open Messages so you can send the first text to a shared line. You text first. There is no app. Mickey does not start the thread.

Answers are written by software from scouting notes. They can be wrong, incomplete, or out of date. Mickey is not a human scout sitting at a gym. We may change or retire a feature. We do not promise that the line or the site will be up, or that a reply will arrive on a schedule.

iMessage delivery and the payment page are run by other companies. Their outages and their terms are theirs. Your carrier may charge message or data rates. We do not set those rates and we do not add a per-message fee. A link we send is not an endorsement of that page.

Texting Mickey

You can send a text or a voice note. A text longer than 1,200 characters is dropped, with no reply. More than 8 messages in 60 seconds are ignored, with no reply. A voice note longer than about 2 minutes, or larger than 25 megabytes, is declined. If transcription is unavailable, we ask you to type, and that reply does not use a free reply. A note that is too long, or that we cannot make out, does use one.

While a reply is on the way, we may mark the message read and send a reaction. Your first text also gets a short introduction and a contact card. Those do not count as one of the free replies below. If that first text is only a greeting, it does not count either. If it asks a scouting question, the answer is reply one. After that, ordinary texts count, including a greeting.

There is no keyword that stops the thread. Texting stop, unsubscribe, or cancel does not cancel a plan, does not delete anything, and does not block later replies. Those words are handled like any other text. Mickey replies when you write, or when a failed delivery of a message you already sent is retried. To ask us to delete what we store, use the contact at the end of these terms.

Price and payment

The first 5 scouting replies are free. After that, the plan published on textmickey.com is $5 a month. When the free replies are used up, the next texts get a link to a payment page instead of a scouting answer.

If you open that page and pay, the payment provider collects the payment details. We do not receive or store your card number, a customer id, or a receipt, and we do not send your phone number to that page from our code. A charge is not tied to your text thread in our records. The site has no account page, and the thread has no cancel keyword. Email [RANKLOG CONTACT EMAIL] about a charge and include the receipt the payment page gave you.

We may change the price. The new price will be posted on textmickey.com before it applies to a later charge. Your carrier’s message and data rates are not part of the $5 and are not refundable by us.

Acceptable use

You agree not to:

• Harass, threaten, or sexualize a player, a minor, or anyone else, or ask Mickey to do that.
• Send or ask for a player’s home address, phone number, health information, or family contacts.
• Scrape the thread, resell replies, or use replies or scouting notes to build or train another product.
• Flood the number, probe the service, or send anything meant to break it.
• Pretend that Mickey, a school, the NCAA, or a league said something they did not, or present a reply as an official recruiting decision.
• Use the service to break the law.

We may ignore a message or stop replying if you break these rules, if a carrier or the messaging network requires it, or if we need to protect a player or the service. There is no separate ban button in the product. Stopping service can mean we simply do not answer.

What a reply is

A reply is an opinion drawn from scouting notes: players, schools, rankings, offers, visits, commitments, and what a scout wrote. It is not coaching advice, legal advice, or a scouting report we promise is complete or current. You decide what to do with it. Mickey is not affiliated with any school, the NCAA, or any athletic league. A reply is not an official decision by a program, and it is not a promise of a scholarship, a visit, an offer, or playing time. We do not guarantee a recruiting outcome.

Intellectual property

You keep what you text us. You give us permission to use that text to run the service: to answer, to keep the thread, to count the free replies, to review reply quality, and to enforce these terms. We do not take ownership of your messages. We do not use your messages to train models, and we do not let anyone else train on them. Because replies are generated, two people can receive similar answers, and a reply may not be protected by copyright.

The site, the look of the service, the Mickey Banks name, and the scouting notes belong to Ranklog or to the people who wrote the notes. While you follow these terms, you may use the service and the replies for your own personal use. You may not copy the notes or the replies in bulk, and you may not use them to build or train another product. We reserve every right we do not expressly give you.

If you send feedback about the service, we may use it to operate and improve Mickey without payment to you, and without giving you a right in the service.

Disclaimers

Mickey is provided as is and as available. To the extent the law allows, we disclaim warranties of accuracy, merchantability, fitness for a particular program, and uninterrupted service. Scouting replies can be wrong. Nothing Mickey says is professional advice, and it does not create a warranty. You are responsible for what you send and for what you do with a reply. Nothing here disclaims a warranty the law does not allow us to disclaim.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for a scholarship, roster, or reputation decision someone makes from a reply. Nothing here limits liability that the law does not allow us to limit.

You will cover us for a claim that comes from your messages, your misuse of a reply, or your violation of these terms, to the extent the law allows.

Termination

If you break these terms, we may stop replying, with or without notice. We may also stop replying to protect a player or the service. There is no separate account to close in the product. Ending use does not, by itself, delete what we store. To ask for deletion, use the contact below. Sections that should survive by their nature, including intellectual property, disclaimers, limits on liability, and governing law, stay in effect after the service ends.

Governing law

These terms are governed by the laws of [RANKLOG GOVERNING LAW STATE], without regard to conflict-of-law rules. Courts in that state are where we expect a dispute to be heard, except where the law where you live gives you a right to go somewhere else. These terms do not require arbitration. They are the entire agreement between you and Ranklog about the service. If a court holds one part unenforceable, the rest stays in effect.

Changes

We may update these terms. We will change the effective date at the top and post the new version on this page. If you keep texting after that date, you are agreeing to the update. We do not have a separate email list for every texter. We may also change the service itself. We do not promise that a particular feature will stay available.
